Attorney Mark Stevens practices in
New Hampshire and Massachusetts. His practice is devoted entirely (100%) to
criminal trials and appeals, with a major concentration in defending clients
accused of DWI, Aggravated DWI, DUI, OUI, boating while intoxicated and other
allegations of drunk driving. He received his Bachelor of Arts degree from the University of New Hampshire
in Durham, New Hampshire
and his Law Degree from the Massachusetts School of Law in Andover, Massachusetts.
Attorney Stevens is the New Hampshire state
delegate to the National College of DUI Defense. Attorney Stevens is a ten time graduate and
member of the National College of DUI Defense (NCDD). In 2008 Attorney Stevens completed the 2008
Winter Session of the National College of DUI Defense, specialized training for
DWI and DUI defense lawyers in Honolulu, Hawaii. In 2006 he completed the Winter Session of the
National College of DUI Defense program in Jacksonville, Florida.
He has attended every summer session of the National College of DUI Defense
since 2002. In 2005, he was appointed to the Board of Directors of the
American Association of DWI Trial Lawyers (AADTL).
Attorney Stevens became a certified
breath test operator in 2004 and also became certified to maintain and repair
the same type of breath test machines used by every police department in New Hampshire in 2004. In
June 2005 Attorney Stevens successfully completed a specialized training course
in Daytona, Florida on the maintenance and repair of the
breath testing machines used by the police. This advanced training involved the
complete breakdown of the machines to the component level utilizing the
manufacturer's tool kit and diagnostic checks on these breath testing machines.
He has also been trained in the
administration of “field sobriety testing” and “marine field sobriety testing”,
the same training received by the police officers who arrest citizens accused of driving while intoxicated (“DWI”) or boating
while intoxicated (“BWI”).
In 2008, Attorney Stevens was a
member of the faculty panel for the Massachusetts Continuing Legal Education
(MCLE) program in Boston, Peabody,
MA and Worcester,
MA on OUI Litigation. In 2007, Attorney Stevens was a panel member
for MCLE’s OUI Litigation program in Andover, MA and Boston,
at which he spoke on Horizontal Gaze Nystagmus
(“HGN”) cross examination strategies. In November 2006 Attorney Stevens
was a member of the teaching faculty at a specialized two-day seminar in
Advanced DWI Defense Techniques in Portland
Maine. This specialized DWI
training course was sponsored by Defenders Education, Incorporated and the
National College of DUI Defense.
In June 2006, Attorney Stevens
completed a three day specialized training in the operations of hand-held and
evidentiary breath testing devices used by the police in New Hampshire DWI
cases. Attorney Stevens has received approximately 100 hours of formal
specialized training from breath testing experts in how these devices operate. He has received not guilty verdicts on
aggravated DWI charges involving alleged breath test readings of .31, and .23,
won an aggravated DWI case with a blood test result of .24 in 2008, and won a case
with a blood test of .23 in 2007. He
has also achieved numerous other victories in breath and blood test cases.
Attorney Stevens has also completed
the National College of DUI Defense’s “Mastering Scientific Evidence in DWI
Cases” in 2007 in Dallas, Texas
and in 2003 in Atlanta, Georgia. He has completed
specialized training in “Marine Field Sobriety Testing” (the “field sobriety
testing” used by police in boating while intoxicated cases).
Attorney Stevens has extensive
experience in DWI trials and related administrative license suspension
hearings. He also has extensive experience in appeals and post-conviction
proceedings. He has received concentrated appellate training, including federal
appellate defense training and appeals and post-conviction training at the
Massachusetts Committee for Public Counsel Services. Attorney Stevens has
obtained notable reversals of DWI convictions in the reported decisions of State v. Sharkey (New Hampshire Supreme
Court), State v. Duffy (New Hampshire Supreme Court) and Commonwealth
v. Ouellette (Massachusetts Appeals Court.
In 2006 he also obtained a reversal in the Massachusetts Appeals Court
of a probation violation for failure to submit to random drug testing in the
case of Commonwealth v. Edgerly. In
2007, he successfully argued in the New Hampshire Supreme Court and obtained a
reversal of a DWI conviction where the defendant had pleaded guilty but the
defendant was unaware of the consequences of his conviction in the case of State
v. Sharkey. New

to practice in all state and federal courts in New
Hampshire and Massachusetts.
He is also admitted to practice in the United States Court of Appeals for the
First Circuit and in the United States Supreme Court. He is a member of the

New Hampshire Association of Criminal Defense Lawyers, the Massachusetts
Association of Criminal Defense Lawyers, the Texas Criminal Defense Lawyers
Association and the National Association of Criminal Defense Lawyers.
