January 14, 2014: New Hampshire Administrative License Suspension/DWI Case Example: A police officer was driving around a one-way traffic circle at about 4:00 p.m. when a car approached him driving the wrong way around the traffic circle.  The officer brought his car to a stop as did the citizen-driver.  The police cruiser and the citizen’s car stopped a few feet away from each other.  Because the citizen was inadvertently disrupting the flow of traffic in the circle, the officer ordered her to move her car onto a side street.  The citizen complied with the order.

After the officer approached the car for the second time (on the side street), he reportedly smelled an “overwhelming smell of an alcoholic beverage” coming from inside the car.  He asked for the citizen’s license and registration, which she politely provided.  The officer asked the citizen to get out of her car, which she did.  The officer asked the citizen if she would perform a series of field sobriety tests; the citizen declined the invitation to perform the roadside acrobatics.  At the police station the citizen refused to blow into the old black breath testing hose at the police station.

Just days after her release, the citizen received the frightening letter from the New Hampshire Department of Safety about the penalty that she was facing for her refusal to take a breath test: the DMV was about to take away his right to drive away for two years for the refusal.  This citizen hired Salem, New Hampshire DWI defense attorney Mark Stevens to fight her license suspension.  After the officer’s testimony, Attorney Stevens cross examined him and then moved to dismiss the two year suspension.  The hearings examiner took the case under advisement.  A few days later Attorney Stevens received the DMV’s decision to throw this suspension out, in part because the officer had not proven that the traffic circle was a public way. This citizen avoided a two year license suspension for refusing to take a chemical test.
