New Hampshire DWI Case Example: The police stopped a citizen for having his plate light out.  After the police stopped this driver the officer began interrogating the driver about drinking.  The officer saw a Budweiser wrist bracelet, common in bars in the area, in the cab of the driver’s truck. The driver told the officer that he had three or four beers and had just left a bar. 

The officer asked the driver to get out of his truck, where he then instructed him to perform the three part “standardized field sobriety tests”, also known as sidewalk acrobatics or roadside gymnastics that lead to New Hampshire DWI arrests.  The driver told the officer about some physical limitations that the driver had, but the officer persisted and had the driver perform these tricks any way.

The driver did the horizontal gaze nystagmus (“HGN”) test, the “walk and turn test” and the “one leg stand test”.  He did well on the first two but could not complete the one leg stand test, hopping on the road until the officer stopped him.  The officer recited the typical “indicators of impairment” at trial: red eyes, slurred speech, staggering, etc.  The problem with all that, from the state’s standpoint, was that a cruiser video taken at the scene told a different story.  At the police station, this citizen declined the officer’s invitation to blow into the breath testing hose.

The driver hired Rockingham County DWI defense lawyer Mark Stevens to defend him in the district court.  The case went to trial because the state did not offer any realistic plea offer.  Attorney Stevens was able to win the trial.    At the end of this DWI trial, the verdict was “not guilty” of driving while intoxicated. 

 

 

Note-this is one example of a recent New Hampshire DUI-DWI case victory. It is by no means a guarantee of any particular result in any other case.
