New Hampshire DWI Case Example: A police officer responded to the scene of an accident.  A caller had called in that his taxi cab had been struck by a car.  The officer arrived and noticed tire tracks leading to a car in a parking lot.  It was snowing at the time he arrived.  The officer entered the parking lot and saw a car running and a woman behind the wheel. 

The officer approached the woman and asked her to step out of her car.  She complied.  She was wearing pajamas and the snow continued to fall.  The parking lot was icy enough that the officer had to seek another location to conduct a 3-part series of field sobriety tests.

The driver did a decent job on these tests all things considered, but the officer arrested her any way.  He reported the usual stock observations of intoxication: bloodshot and glassy, a strong odor of alcohol coming from inside the vehicle, etc.  He noted the usual medley of “clues of impairment” on these field sobriety tests and subsequently arrested the driver for driving while intoxicated.  At the police station, this citizen decided to blow into the breath testing hose.  The machine printed a test result that said her breath alcohol level was a .16.  Prosecutors like to say that this is “twice the legal limit”.

Salem, New Hampshire DWI defense attorney Mark Stevens represented her at both her administrative license suspension hearing and at her trial.  The case was forced to trial because the state did not offer any sort of realistic plea offer.  Attorney Stevens was able to win both the hearing and the trial.    At the end of the trial, the verdict was “not guilty” of DUI.  She never lost her right to drive at all.

Note-this is one example of a recent New Hampshire DUI-DWI case victory. It is by no means a guarantee of any particular result in any other case.

RESULT:    Not guilty of DWI!
