DWI CASE EXAMPLE: A citizen was arrested for DWI.  He declined the arresting officer’s invitation to incriminate himself with a breath test after his arrest.  The citizen first went to court without a DWI defense lawyer and made a really bad plea deal that haunted him for years.  This citizen suffered a long license loss, paid a large fine, was forced to complete a program, and obtain an SR-22 proof of financial responsibility certificate and maintain it for three long years after he got his right to drive back.

        The citizen was not really aware that he had another option, namely fighting the case and going to trial.  He also did not realize that this bad plea deal would come back to bite him when he was accused of another DWI allegation years later.  Concerned about all these problems that an ill-advised decision to plead guilty caused him, the citizen hired Salem, New Hampshire criminal defense Attorney Mark Stevens to attempt to clean up the mess of his old New Hampshire DWI conviction.

Note-this is one example of a recent New Hampshire DWI case victory. It is by no means a guarantee of any particular result in any other case.

STRATEGY:         Attorney Stevens successfully moved to vacate the prior conviction, which reopened the case based on constitutional defects with the plea and conviction.  Once the conviction was vacated, Attorney Stevens successfully moved to dismiss the DWI charge on the new trial date, saving this driver two years of license loss.

RESULT:    DWI-first offense case dismissed after motion to dismiss granted.
